Pre-launch note: These terms have been drafted with reference to the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010) and general hire law principles. They should be reviewed by a qualified Australian solicitor before the site goes live.
1. About these terms
These Terms and Conditions govern the hire of equipment from Roamkit ABN: 71 738 326 117 (“Roamkit”, “we”, “us”). By placing a booking, you agree to be bound by these terms. Please read them carefully before booking.
2. Hire agreement
When you complete a booking, you enter into a hire agreement with Roamkit for the equipment specified in your booking confirmation. The hire period begins on your nominated start date and ends on your nominated end date.
You are responsible for the equipment from the time of delivery until collection. The equipment remains the property of Roamkit at all times.
3. Payment
All hire fees are payable in full at the time of booking via our secure payment provider (Stripe). Prices are displayed in Australian dollars and include GST.
A delivery fee applies to all bookings. The delivery fee is shown at checkout and covers delivery to and collection from your nominated address.
4. Damage deposit
A refundable damage deposit of $100 is charged at the time of booking. It will be refunded to your original payment method within 48 hours of equipment collection, provided the equipment is returned without damage beyond fair wear and tear.
If damage occurs, Roamkit reserves the right to retain the deposit to offset the cost of repair or replacement. You will be contacted before any decision is made. Where repair or replacement costs exceed $100, additional charges may apply.
The deposit is shown as a separate line item at checkout and will appear on your payment statement alongside the hire total.
5. Cancellations and refunds
Cancellations made more than 48 hours before your hire start date are eligible for a full refund, less any payment processing fees.
Cancellations made within 48 hours of your hire start date are non-refundable.
If Roamkit is unable to fulfil your booking due to circumstances within our control, you will receive a full refund including the delivery fee.
6. Delivery and collection
We deliver to and collect from addresses within our service area. Delivery occurs at your preferred time — morning or afternoon — on your hire start date; collection occurs on your hire end date. Your preferred delivery window will be confirmed prior to delivery.
You must ensure the equipment is accessible for collection at the agreed time. If collection cannot be completed due to access issues on your end, additional charges may apply.
7. Equipment condition and care
All equipment is delivered clean, sanitised, and in good working order. You agree to:
- Use the equipment only for its intended purpose
- Not modify, repair, or attempt to repair the equipment
- Not sublet or lend the equipment to any third party
- Return the equipment in a reasonable condition (fair wear and tear excepted)
You are not required to clean the equipment prior to collection — ordinary use is expected. However, equipment returned excessively soiled or damaged may incur a cleaning or repair fee.
8. Damage and liability
You are liable for any loss of or damage to the equipment beyond fair wear and tear during the hire period. If the optional damage waiver was selected at checkout, it covers accidental damage only and does not cover loss, theft, or intentional damage.
Where the damage waiver was not selected and damage occurs, we will contact you with the cost of repair or replacement. Repair and replacement costs are based on the actual cost to Roamkit.
Roamkit’s liability to you is limited to the total amount paid for your hire. We are not liable for indirect, consequential, or special damages arising from use of the equipment.
9. Safety
All equipment is checked for safety before each hire. However, it is your responsibility to ensure equipment is used correctly and safely, particularly when used by or around children. Always follow the manufacturer’s instructions and Australian safety standards. If you notice any defect or safety concern with the equipment, stop using it immediately and contact us.
10. Service area
Our service area is limited to specific suburbs within the Shoalhaven region of NSW. If you provide an address outside our service area at checkout, we will contact you to discuss options. Delivery to addresses outside our service area is at our discretion and may incur additional fees.
11. Governing law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
